1. Accepting these terms
This website is operated by Cook and Etc, 7235 Boul. Gouin E., Montréal, QC H1E 6N1. By browsing this website or sending us anything through one of our forms, you agree to these terms. If you do not agree with them, please do not use the site.
If you are using the site on behalf of a company or an organisation, you confirm that you are allowed to accept these terms for them.
2. What this website is for
This website is an information and enquiry site. It describes Cook and Etc's catering, event, at-home chef and food import and distribution services, shows our work, and lets you contact us through three forms: a general contact form, an event and catering request form, and an import and distribution enquiry form.
Sending a form is a request, not a booking. Nothing on this site is a binding offer. A booking or an order exists only once we have confirmed it with you directly in writing, at an agreed price and on agreed dates. Prices, menus, availability and service descriptions shown here may change without notice.
3. Acceptable use
You may read, print and share the pages of this site for your own personal or internal business use. When you use the site, please do not:
- Send false, misleading or impersonating information through our forms, or use someone else's contact details.
- Upload anything unlawful, defamatory, hateful, obscene, or anything you do not have the right to share — including photographs you do not own the rights to.
- Upload a file that contains a virus or any other harmful code.
- Use the site to send advertising, chain messages or bulk unsolicited enquiries.
- Try to get around our anti-spam checks, break into any part of the site or its hosting, or test its security without our written permission.
- Use robots, scrapers or other automated means to harvest content or contact details from the site.
- Copy the site, or a substantial part of it, to build a competing service.
- Interfere with the site's normal operation or place an unreasonable load on it.
4. Who owns what
Everything on this website — the text, the photographs, the food and event images, the logos, the Cook and Etc name, the page layouts and the design — belongs to Cook and Etc or to the people who licensed it to us, and is protected by copyright and trademark law. You may not copy, republish, sell or adapt it for commercial purposes without our written permission.
What you send us stays yours. When you upload inspiration photos or write a message in one of our forms, you keep ownership of it. You give us permission to use it for the purpose of answering your enquiry and, if we work together, of planning and delivering your event or order. We will not publish anything you send us — for example in our gallery or on social media — without asking you first.
You confirm that you have the right to send us whatever you upload.
5. Disclaimers and limits on our liability
We work to keep this site accurate and available, but we cannot promise that it will always be free of errors or interruptions, or that the information on it is complete and current at every moment. Menus, service descriptions and images are illustrative.
The site may link to other websites, such as our social media pages. We do not control those sites and are not responsible for their content or their privacy practices.
Allergies and dietary requirements: information about ingredients shown on this site is general. If you or your guests have a food allergy, an intolerance or a religious or medical dietary requirement, you must tell us directly before we confirm an order, and we will confirm in writing what we can accommodate. Please do not rely on this website alone for that.
To the extent the law allows, we are not liable for indirect or consequential loss arising from your use of this website, such as lost profit or lost opportunity. Nothing in these terms excludes or limits our liability for bodily or moral injury, for intentional or gross fault, or for anything that cannot be excluded under Quebec law.
Your rights as a consumer are protected. If you are a consumer within the meaning of Quebec's Consumer Protection Act, nothing in these terms takes away, reduces or replaces the rights and warranties that Act gives you, including the legal warranty of quality. Where a clause here conflicts with those rights, your rights under the Act prevail.
6. Indemnification
If you break these terms or use this website unlawfully, and that causes a third party to bring a claim against us, you agree to cover the reasonable losses, damages and legal costs we incur as a direct result. This does not apply to anything caused by our own fault. We will tell you promptly about any such claim and will not settle it without talking to you.
7. Suspending or ending access
We may block access to this website, or to our forms, from a person or an address that is sending abusive, automated or unlawful submissions, that is attempting to breach the site's security, or that is otherwise breaking these terms. Where it is reasonable and lawful to do so, we will tell you why. You can stop using the site whenever you like.
Sections about intellectual property, liability, indemnification and governing law continue to apply after access ends.
8. Governing law and resolving disputes
These terms are governed by the laws in force in the province of Quebec and the federal laws of Canada that apply there. If we cannot resolve a disagreement between us, the courts of the judicial district of Montréal, Quebec, have jurisdiction. If you are a consumer, this does not deprive you of the right to bring proceedings where the law entitles you to.

9. Changes to these terms
We may update these terms as our services change. When we do, we will post the new version on this page and change the date below. If a change materially affects your rights, we will make it clear on the site so you have a fair chance to read it before continuing to use the site. Continuing to use the site after a change means you accept the updated terms. The version in force is always the one published here.
